JUDGMENT ARVIND K. TRIPATHI, J. – Heard learned Counsel for the applicant, learned AGA and perused the record. 2. The applicant is involved in. Case Crime No. 207/2008, under sections 304 and 147 IPC, P.S. Gangoh, District Saharanpur. 3. Counsel for the applicant contended that the marriage of applicant Karnail Singh was solemnised with Jinder in the year 1997-98. This is a case of dowry death but there was no complaint regarding torture to the deceased. It appears that due to any reason some quarrel took place with the applicant, hence she consumed poison and when applicant returned from his field immediately she was rushed to hospital and she was got admitted. On the basis of suspicion first information report was lodged on 12.5.2008, thereafter an application along with affidavit was given by the father of the deceased to Senior Superintendent of Police on 23.5.2003 to the effect that his daughter herself has taken some poisonous stuff and her in-laws were not responsible for the same rather they got admitted for treatment in the hospital. The applicant is in jail since 24.10.2008. 4. Without any observation on merit, in view of the above fact of the case let the applicant Karnail Singh involved in Case Crime No. 207/2008, under sections 304 and 147 IPC, P.S. Gangoh, District Saharanpur be released on bail on his furnishing a personal bond with two sureties each in the like amount to the satisfaction of the Court concerned. Application Allowed.
