AMARESHWAR SAHAY

body2008
ORDER Amareshwar Sahay, J. 1. Heard the parties. 2. The petitioner is the Association of students of the Department of Forestry in Birsa Agriculture University, Kanke, Ranchi. In this application the prayer has been made for quashing of the Notice/Appeal dated 23.2.2008 issued by the Dean, Faculty of Forestry, contained in Annexure-3 as also the Final Notice/Appeal dated 24.2.2008 issued to Forestry Students by the Director Students Welfare, contained in Annexure-4, whereby request has been made to the students of the Forestry Department, occupying rooms in Hostel No. 4 of the said University, to shift to Bhairwi Guest House, which has been converted and suitably furnished to accommodate the students. 3. It appears that since there was some dispute and unrest among the students of two faculties, i.e. amongst the students of Forestry and Agriculture and, therefore, the administration of the University had to request the students of Forestry faculty to vacate Hostel No. 4 and shift to Bhairwi Guest House, which has been converted into a Hostel for accommodation of the students to avoid dispute and tension/unrest in between the students of the two faculties. 4. Mr. Sumir Prasad, learned Counsel appearing for the petitioner submitted that Bhairwi Guest House is not suitable for hostel because there is shortage of accommodation and the basic amenities like electricity and water etc. are also not available there. 5. But as it appears from Annexure-4, i.e. the final appeal made by the Director Students Welfare that the said Bhairwi Guest House has been converted and suitably furnished in all respect for the accommodation of the students. The notices/appeals, contained in Annexures-3 and 4, in my view, have been made on administrative ground in order to prevail peace and, harmony in the campus of the University. 6. This Court does not want to interfere in such administrative matters. The University authorities are the best persons to take appropriate decision in such matter. 7. Accordingly, this writ petition is dismissed. However, it is observed that University authorities shall see that the students are suitably accommodated in the new Hostel and they be provided all the basic amenities, which are required for a proper Hostel. Petition dismissed.
