ORDER 1. Heard. 2. Admit. 3. The applicant has filed this application under section 438 of CrPC for grant of anticipatory bail. The applicant is apprehending his arrest in Crime No. 72/98 at Police Station Mayapur District Shivpuri for the offence punishable under sections 294, 323, 324/34 and 506B of IPC. It is submitted that the charge sheet has been filed, wherein, the applicant has been shown as abscording accused and the trial Court has issued the permanent arrest warrant of the applicant/accused for his presence. It is further submitted that the case is tribal by JMFC and the applicant is ready to surrender himself before the Court concerned and to face the trial, hence, prayed for grant of anticipatory bail. 4. Learned penal lawyer opposed the application and prayed for its rejection. 5. Considering the overall facts and nature of the case, application is allowed and it is directed that if the applicant surrenders himself within 15 days from the date of receipt of copy of this order before the JMFC, Pichore in the aforesaid Criminal Case No. 7/08 arising out of Crime No. 72/98, registered by police Mayapur District Shivpuri for the offence under section 294, 323, 324/34 and 506B of IPC, in that case, he be released on bail on his furnishing a personal bond of Rs. 20,000/- (Rs. twenty thousand only) with one solvent surety of the same amount to the satisfaction of the Court concerned. A copy of this order be sent to the Court concerned for compliance.
