Learned Addl. District Judge set aside the judgment and decree dated 24.5.2005 and remanded the matter to the trial court in the terms referred above. The contention of learned counsel for the appellant is that the appellate court, instead of remanding the matter, should have decided the matter on merits. 3. I have considered the arguments advanced and examined the judgment impugned. Learned appellate court by the judgment impugned accepted the application preferred under Order 41 Rule 27 CPC dated 4.7.2005, the application under Order 41 Rule 27 CPC dated 20.3.2006, the application dated 20.4.2004 preferred under Order 6 Rule 17 CPC, the application dated 24.5.2006 preferred under Order 6 Rule 17 CPC and also permitted to the plaintiff to submit the rejoinder to the extent permission was granted to the defendant to amend the written statement. As a consequent to the acceptance of the application referred above matter certainly requires adjudication by the trial court, and therefore, no error has been committed by the appellate court in remanding the matter to the trial court while setting aside the judgment and decree. Thus, I do not find any merit in this appeal and the same therefore is rejected.Appeal Dismissed. *******
