body2008
ORDER 1. So far as the Intervention Petition is concerned, it appears to be in persuit for enquiry into misappropriation of funds disbursed by the Central Government by disbursing authority for purposes other than the education or for purposes other than the Governmental requirement. 2. This issue is not a part of question as raised in the two petitions, which primarily concerned with the reach of education to the areas where it has not reached particularly for the education of children below 14 years and for proper functioning and implementing Sarva Shiksha Abhiyan in the State of Bihar. 3. We are, therefore, of the opinion that the Intervention Petition ought not to be tagged with the two petitions, which relates to an entirely different subject matter. If interveners want to pursue the cause disclosed in their application, they may bring the fresh petition by placing all the relevant materials on record. 4. So far as the petition is concerned, we direct the learned Government counsel to place on record the steps taken for implementing the scheme for improving education system in the State of Bihar since filing of the petition by giving the relevant statistics about the projects undertaken by it, projects completed and the projec1s in progress or in contemplation, the amount spent in respect of such projects and the tangible results of the schemes already implemented by the State so that the submission made by learned counsel that there has been satisfactory improvement in education in past few months can be appropriately evaluated. 5. Counsel for the State shall also furnish data revealing comparable state of affairs, existing before filing the petition and existing state of affairs as on today. 6. Six weeks time is allowed as prayed for. 7. Let a copy of this order be handed over to the learned counsel for the petitioner and learned counsel for the State.
