Judgment :- 1. This writ petition has been filed by the petitioner Mill, praying for a writ of mandamus, to forbear the respondents from taking any coercive steps under the Revenue Recovery Act or by prosecuting the petitioner Mill for collecting the arrears and interest pursuant to the Letter No.51-9140-11 Ins.VI, dated 22. 2001, on the file of the first respondent. 2. It is submitted that nearly 600 employees are employed in the petitioner Mill. Due to acute shortage of raw materials, the petitioner Mill had suffered severe losses and therefore, the petitioner Mill has not paid the Employees State Insurance contribution due to the Employees State Insurance Corporation. In such circumstances, the first respondent has demanded a sum of Rs.4,60,575/-, as arrears of contribution from the petitioner Mill to the Employees State Insurance Corporation. An interest of Rs.20,455/-has also been proposed by the first respondent for the belated payment of the Employees State Insurance Contribution due from the petitioner. 3. At this stage of the hearing of the writ petition, the learned counsel for the petitioner had submitted that the amounts due from the petitioner as Employees State Insurance contribution and the interest thereon would be paid by the petitioner Mill to the first respondent within a period of eight weeks from the date of receipt of a copy of this order. The learned counsel for the petitioner had submitted that an amount of Rs.2,30,281/- had already been paid by the petitioner Mill to the respondent Corporation, pursuant to the order passed by this Court, on 23. 2001, in W.M.P.No.8461 of 2001. Hence, the petitioner is liable to pay only the balance amount due the respondent Corporation. 4. In view of the above submission, the petitioner Mill is directed to pay the balance amount to the Employees State Insurance Corporation, within eight weeks from the date of receipt of a copy of this order. With the above observations, the writ petition stands closed. No costs.
