ORDER : P.R. Raman, J. 1. Special Commissioner has made a report to this Court which was referred for further consideration by the Ombudsman and for making effective suggestions. The Ombudsman, after hearing of the parties and after considering the matter, has made 8 suggestions to this Court for consideration in the matter of allotment of rooms at Sabarimala and Pamba for the next season onwards. The following are the suggestions: "1. The Accommodation Officer at Sabarimala must be given full charge of all the rooms including the rooms in Sabarinivas Guest House and Guest House Annexe. The name-boards of all the officers of the various departments put in front of the rooms in Sabari Guest House and Guest House Annexe should be removed; before the season starts and allotment of rooms to such officers must be made either on their request when they are on actual duty at Sabarimala or when they make request for accommodation. 2. At the time when the Government/Police Officials leave the room after duty, the key of the respective room must be obtained by the Accommodation Officer. 3. The total number of rooms which are to be reserved for official purposes must be ascertained at least two weeks before starting of the season by the Accommodation Officer in consultation with the Executive Officer, Chief Engineer and the Special Commissioner and such number of rooms should be reserved without allotment. These rooms can be allotted as and when the Officers come for official duty. 4. En block allotment of rooms for the entire season should not be allowed except in cases where agreement under which the license was created allows such allotment and in cases of association of persons who have donated amounts for the benefit of such members. They are (1) Lawyers Centre Room Nos. 7 & 8 (2) Sree Vigneswara Community Centre Room Nos. 13 & 14 in Donor House 1 and 6 and 7 in Donor House III and (3) Sree Ayyappa Bhaktha Sabha Room No. 19 in Maramath Complex. In other cases, the donors can give the names of persons whom they desire to accommodate in advance to the Accommodation Officer who can allot the room. Computerised allotment of rooms in the Sabari Guest House, Pilgrim Centres and Donor houses must be implemented. 6. In Pampa Guest House except the rooms for the President and Members of the Board and the rooms required by the Devaswom Board for its officers including Local Fund Audit and Duty Magistrate, all other rooms must be made available for the devotees requiring such accommodation and other name boards must be removed and health officials can be allotted room on request and if available, the Administrative Officer, Pampa, will allot room. The Administrative Officer, Pampa, must be in-charge of the allotment of rooms at Pampa Guest House. The Chief Engineer may fix the rent for the rooms to be allotted to the devotees in Pampa Guest House, as no rent is so far fixed for those rooms. 7. If any complaint is there for any donor or devotee about the allotment of rooms, the direction of the Special Commissioner, Sabarimala must be sought and obtained. The Special Commissioner also may be authorised to see that the guidelines are implemented in letter and spirit. 8. The Accommodation Officer must also see to it that sufficient attendants are posted in each Guest House and donor building shelters to attend to cleaning of the rooms immediately the incumbent vacates and to see that there is no leakage of water and to see that devotees have a comfortable stay at Sabarimala." 2. The Board accepted the suggestions made by the Ombudsman except item Nos. 5 and 6. Hence this Court directed to file a statement with regard to the suggestion made in item Nos. 5 and 6. Accordingly, the Board has filed a statement. As regards the 5th suggestion relating to allotment of rooms, it is stated that a scheme for computerisation of 25 temples including Sabarimala Temple is under consideration of the Board and therefore this could be implemented while implementing the said scheme. We find that computerisation of 25 temples including Sabarimala Temple will take some more time.

Whereas computerisation for allotment of rooms in Sabarimala and Pampa is to be done separately, so that the devotees coming from outside the State can know in advance the vacancy position and plan accordingly. Hence, allotment of rooms in Sabarimala and Pampa may be computerised before the Mandalam-Makaravilakku season. Hence, the Board shall take immediate steps for implementation of the same. 3. As regards the 6th suggestion, it is stated that the room rent had already been fixed as per the order of the Board dated 09/11/2006. Obviously, this is not brought to the notice of the Ombudsman. Hence, we find that a further fixation is not called for. All the above suggestions are therefore accepted for implementation. Report is closed.
