ORDER As per Hon'ble Shri Sunil Kumar Sinha, J. : Heard. This is an application filed under Section 439 of the Code of Criminal. Procedure for grant of regular bail to the applicants, who have been arrested in connection with Crime No.188/2008, registered at Police Station-Kharora, District Raipur (CG) for commission of the offence punishable under Section 302/34 of the I.P.C. The deceased Dev Singh Sahu was uncle of the applicants. They were residing separately. On 27.6.2008, the deceased was found in unconscious and injured condition at an open place in his field. He was taken to the hospital. A Dehati Nalishi was given by the daughter of deceased namely Bodin Bai on 27.6.2008 at 9.45 a.m. She did not mention the names of assailants in the said Dehati Nalishi. The deceased died in the hospital on 3.7.2008. He was through out unconscious. During the course of investigation, the applicants were taken in custody and their memorandum statements were recorded on 19.7.2008 u/s 27 of the Evidence Act, on which, Dandas were seized at their instance. No F.S.L. report has been obtained till date. Learned counsel for the applicants argues that the applicants have been falsely implicated in this case. He also argues that except the memorandum statements of the applicants, there is no other evidence against them in this case. About Dandas, he argues that no blood like stains were found on them and such an article is very common in village. He prays for releasing the applicants on regular bail. On the other hand, learned state Counsel opposes these arguments. Considering the facts and circumstances of this case particularly considering that except the evidence of recovery of Dandas at the instance of the applicants, there is no other evidence in this matter, as stated by the Government Advocate, I am of the opinion that present is a fit case to enlarge these applicants on regular bail. Accordingly, their application filed under Section 439 Cr.P.C. is allowed. It is directed that these applicants shall be released on bail on each of them furnishing a personal bond in sum of Rs. 10,000/- with one surety each in the like sum to the satisfaction of the trial Court for their appearance before the said Court on each date of hearing till disposal of the trial. Certified copy as per rules. Bail Granted.
