1. The applicant has filed these two applications for transfer of the cases titled Mohd Shafi Vs. Alam Din pending for disposal before the court of Additional Deputy Commissioner, Rajouri to any other court of competent jurisdiction. 2. The Tehsildar, Kotranka attested the mutations Nos:875 dated 18.9.2004 in respect of land measuring 5 kanals 11 marlas and mutation No:799 dated 20.01.1988 in respect of land measuring 1 kanal 7 = marlas comprising Khasra No:38 situated at village Rehan, Tehsil Kotranka. The applicant filed appeals before the Additional Deputy Commissioner, Rajouri against the orders of attestation of these mutation. It is alleged that the Additional Deputy Commissioner, Rajouri has openly declared that he would upheld the mutation and shall not consider the legal points being raised by the applicant in the appeals. Apprehending that the applicant would not get justice, the applicant filed the present applications. 3. The Additional Deputy Commissioner, Rajouri has denied the allegations in his parawise reply submitted to this Tribunal. 4. I have heard Learned counsel for the applicant and have perused the record. 5. At the time of hearing this application an objection has been raised about the maintainability of this application before this Tribunal. Under Section 3 of the J&K Special Tribunal Act, 1988,this Tribunal has jurisdiction to hear the appeals, revisions or review petitions which under any law lies to the Government or a Minister or any such appeals, revisions and review petitions for which law has been enacted by the Legislature. 6. The instant case arises out of the mutations attested under the provision of Agrarian Reforms Act. There is no provision in the Agrarian Reforms Act whereby any transfer application lies before the Minister or Government. Neither this Tribunal is specially empowered under any provision of law to hear such types of application. Thus this Tribunal has no jurisdiction or power to hear any transfer application. 7. For the fore-going reasons, I would hold that there is no merit in these applications which are accordingly dismissed. However, the applicant is at liberty to move the proper forum, if law so provides. 8. Let a copy of this order be placed on both the applications. The files of this Court be consigned to record after due completion.
