JUDGMENT 1. :- The learned counsel for the accused petitioner submits that on moving application under Section 319 Criminal Procedure Code the Court ed and the petitioner was made accused by the learned trial Court on 15.6.2007. It has also been contended that other accused petitioners have already been granted bail which are similarly situated, therefore, the case of the accused-petitioner for grant of bail should he considered. 2. The learned P.P. has opposed the application. 3. I have carefully considered the submissions made before me and perused the impugned . 4. It appears that this Court granted bail to Suresh Kumar and Pawan Kumar on 10.1.2008 (S.B. Cr. Misc. II Bail Application No. 4745/2007). It further appears that this Court granted bail to Parmeshwari on 24.1.2008 (S.B. Cr. Misc. Bail Application No. 485/2008).In the above circumstances I deem it proper to allow the application for bail moved by the applicant under Section 439 Criminal Procedure Code.In the result, the bail application is allowed and it is hereby directed that applicant (1) Jain Prakash S/o Shri Subhash Chand a shall be released on bail in F.I.R. No. 107/2006 of P.S. Kbairthal, Distt, Alwar provided that he furnishes a personal bond in the sum of Rs. 30,000/- alongwith two sureties in the sum of Rs. 15,000/- each to the satisfaction of the concerned Court with the stipulation to appear before that Court on all dates of hearing and as and when called upon to do so till conclusion of the trial.Application allowed. *******
