JUDGMENT 1. - Heard learned counsel for the applicants as well as learned Public Prosecutor for the State and perused the case diary. 2. Initially a case was registered against accused-applicants under Sections 279 and 304-A I.P.C. During investigation, Section 304 I.P.C. was also incorporated. Applicants are already on bail on furnishing bail bonds. 3. Taking into consideration all the facts and circumstances of the case and without expressing any opinion on merits of the case, I allow the bail application of the applicants under Section 438 Cr.P.C. Therefore, the SHO/I0 of Police Station Kotputli, District Jaipur is directed that in the event of arrest of the applicants [1] Prakash S/o Shri Sultan and [2] Malaram S/o Shri Shiv Lal in F.I.R. No. 489/2006, registered under Sections 279, 304-A and 304 I.P.C. [later on added], he shall enlarge them on bail provided each of them furnishes a personal bond in the sum of Rs. 50,000/- together with two sureties in the sum of Rs. 25,000/- to his satisfaction on the following conditions: (i) They shall make themselves available for interrogation by Investigating Officer as and when requires; (ii) They shall not directly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any Police Officer; (iii) They shall not leave India without the previous permission of the Court.
