Vinod Gupta

body2008
1. The petitioner has filed this revision petition against the order dated 12.11.2007 passed by respondent No:1 whereby respondent No:2 has been nominated as Director on the Board of Directors. The petitioner's bank challenged this order in this revision petition on the ground that respondent has contravened under Section 29(6) of the Jammu and Kashmir, Cooperative Societies, Act of 1989. 2. The respondents did not appear despite services. 3. I have heard the Learned counsel for the petitioner and have perused the record on the file. 4. The Learned counsel for the petitioner has stated at bar that Government has issued fresh order for the nomination of Respondent No:2 to the Board of Directors during the pendency of this revision petition. Under Section 29(6) of the Jammu and Kashmir Cooperative Societies, Act of 1989 empowered Government to nominate any person to the Board of Directors of any Cooperative Societies and not the Registrar. The impugned order of Registrar (Respondent No:1) has been superceded by the order of Government and lacuna left has been fulfilled. 5. In such circumstances, the Learned counsel for the petitioner does not want to press his revision petition which is dismissed as infructuous. 6. Record of the court below be sent back and file of this Tribunal be consigned to record after due completion.
