Judgment 1. Having heard learned counsel for the appellant, we do not find any merit in this appeal. 2. Respondents have not appeared. 3. The appellant has been suspended having been detained in jail from 17.5.2007 to 2.7.2007, vide Annexure 1 annexed with the writ petition, petitioners headquarter during suspension was made at Vaishali (Hajipur) and it was also the part of the order that the subsistence allowance shall be payable to the petitioner from the office of the Co-operative Office at Vaishali (Hajipur). 4. After the release the petitioner instead of joining at place where his Headquarter was during suspension, attempted to join at Patna but when he was denied joining at Patna and directed to join at Vaishali (Hajipur) he reported his joining at Vaishali (Hajipur) on 3rd July. 2007. Since then. he was making representation at Patna Office for making payment of subsistence allowance for the period of suspension but he has not represented for payment of subsistence allowance from Vaishali (Hajipur) Office of the Joint Registrar, Cooperative Society, from where the subsistence allowance was directed to be paid. 5. After release from jail, the petitioner was transferred on 25.10.2007 alongwith revocation of order of suspension. 6. Aggrieved with the order of transfer as well as non-payment of the subsistence allowance he has preferred C.W.J.C. No. 12190 of 2007. 7. So far as the contentior, of the appellant about non-payment of subsistence allowance was concerned, noticing that the appellant has not been paid subsistence allowance although a direction was issued to the respondent for the payment of salary and subsistence allowance, the learned Single Judge directed the respondents that the appellant should, be paid his salary and the amount of subsistence allowance due to him, specially in view of the fact that the Joint Registrar, Patna has already issued Memo no. 5907 dated 2.11.2007 to the District Cooperative Officer, Vaishali at Hajipur regarding the dues of the petitioner. 8. Apparently, the appellant instead of approaching at Vaishali (Hajipur) Office has continued to persist Patna Office for payment of dues which, was not contemplated. In our opinion, he himself is responsible for not securing timely payment from Vaishali (Hajipur). No relief can be granted to appellant about his grievance against his transfer to Darbhanga while revoking suspension order only on the ground that no separate orders were issued. 9.

We do not find any merit in this appeal and the same is hereby dismissed. 10. The petitioner, if he is interested, must file proper application before the Joint Registrar, Vaishali at Hajipur for payment which shall be released within 15 (fifteen) days.
