Judgment Jayanta Kumar Biswas, J. This is a totally misconceived writ petition. The petitioners are seeking a mandamus directing the respondents to enforce an award made by the arbitrator under S.95 of the West Bengal Cooperative Societies Act, 1983. An award made under S.95 is to be executed in terms of the provisions in R.179 of the West Bengal Co-operative Societies Rules, 1987. An award made under S.95, in terms of the provisions in R.179, is enforceable by any civil court having local jurisdiction in the manner as a decree of such court as if it were a decree of the court. This being the clear legal position for enforcement of an award, the petitioners are not entitled to approach the writ court seeking enforcement of the award. For these reasons, I dismiss the writ petition. There shall be no order for costs.
