The petitioner is alleging inaction on the part of Baranagar Municipality, Kolkata in that his complaint dated October 8th, 2007 (at page22), though was duly received by the municipality, was not taken into consideration for registering an appropriate case for demolishing unauthorized constructions and arresting further constructions undertaken by a club of which one Manmathanath Pal gave out himself to be the secretary. It is submitted that notice was given to the respondents. However, none appears for the seventh respondent or for Manmathanath Pal. In my view, the municipality should have responded to the petitioner’s complaint either by rejecting it and informing that to the petitioner, or by registering appropriate case under appropriate statute. Once it received a complaint from a citizen residing within the area of its activities, in my view, the municipality was not supposed to remain inactive and silent. I think purpose of justice will be served, if the writ petition is disposed of giving necessary directions. For these reasons, I dispose of the writ petition ordering as follows. After examining the complaint, a copy whereof shall be supplied to the chairman of the municipality at the time of communicating this order, the appropriate authority of the municipality shall inform the petitioner whether a case has been made out for registration, and if so whether a case has been registered under the appropriate provisions of the appropriate statute. Steps for the purpose shall be taken within a fortnight from the date of communication of this order to the chairman. If a case is registered, then a copy of the complaint shall be served on the seventh respondent and also on Manmathanath Pal & other persons who may be affected by any decision that will be ultimately given in the case, and all such persons shall be given opportunity of submitting their respective objections. Then necessary inquiries and inspections shall be made and after recording evidence and hearing the parties appropriate reasoned decision shall be given by the competent authority, and all these exercises shall be carried out and completed within ten weeks from the date of registration of the case. There shall be no order for costs.
