Judgment :- M. Chockalingam, J. 1. This is a petition for issuance of a writ of habeas corpus filed by one Muthuguna seeking production of her daughter Ranjitha alleging that she is aged 17 years; that she was found missing from 30.10.2008; that she lodged a complaint before the first respondent on 11. 2008; but, no action has been taken yet, and under the circumstances, she has brought forth this petition. 2. When the matter was taken up in the last hearing, notice was taken by the Additional Public Prosecutor for the respondent No.1. 3. This day, the detenue is produced before the Court. She is enquired. According to her, she was born on 8. 1991, and she went along with the second respondent and married him, and the marriage took place at Coimbatore on 310. 2008, and they have been living for a month, and now she has been secured by the police, and she is ready and willing to go with her mother, and she is to complete her studies. 4. The statement of the alleged detenue is recorded. It is not in controversy that she was found missing from 30.10.2008, and a complaint was given on 11. 2008. The police have secured her. It is also represented by the State that the respondents 2 and 3 are not yet secured, and a case was registered in Crime No.82/2008, and it is also pending investigation. It is also brought to the notice of the Court that she was born on 8. 1991, and thus she is a minor. The petitioner is also present. Under the circumstances, there is no impediment in handing over the custody of the detenue to her mother. Accordingly, it is ordered, and this habeas corpus petition is disposed of.
