Gopal v. State of Rajasthan

H.R.PANWAR

body2008
JUDGMENT 1. - By the instant criminal misc. petition the petitioner has challenged the order dated 07.06.2007 passed by learned Sessions Judge, Hanumangarh imposing a condition of depositing a cash security by bank draft and to surrender before the trial Court. The petitioner is aggrieved only to the extent of imposing a condition of depositing cash security by bank draft of Rs. 20,000/-. 2. I have heard learned counsel for the parties. Perused the order impugned. 3. In my view, such a condition is erroneous. No such condition should normally be imposed for depositing cash security by bank draft, when a person has been directed to surrender before the trial court and move a bail. 4. In the circumstances, therefore, the order impugned dated 7.6.2007 to the extent directing the petitioner to deposit a bank draft of Rs. 20,000/- as cash security is set aside and the rest of the order is maintained. 5. The criminal misc. petition is accordingly disposed of. Stay petition also stands disposed of.Petition disposed of as above. *******
