M.VENUGOPAL

body2008
Judgment :- 1. The revision petitioner / plaintiff has filed this revision petition seeking for early disposal of the suit in O.S. No. 260 of 2005 pending on the file of the Sub-Court, Namakkal. 2. The learned counsel appearing for the revision petitioner / plaintiff contends that in the main suit in O.S. No. 260 of 2005 on the file of the learned Sub-Judge, Namakkal, issues have been framed as early as on 07.02.2006 and the matter is adjourned to 05.01.2009 for trial and the last hearing date being 111. 2008 and that the present suit has been filed based on mortgage and, therefore, prays for fixing a time frame for disposal of the case by the trial Court. 3. The contention of the learned counsel for the revision petitioner / plaintiff appears to be a reasonable one and inasmuch as the issues have been framed on 07.02.2006 and since the matter is pending for a long time for trial, this Court, as a matter of prudent course, directs the learned Sub-Judge, Namakkal, to dispose of the main suit in O.S. No. 260 of 2005 within a period of four months from the date of receipt of a copy of this order and to report compliance. With this observation, the Civil Revision Petition is disposed of, leaving the parties to bear their own costs.
