JUDGMENT 1. - By way of this petition the petitioner has prayed as under : "(i) by an appropriate writ, order or direction the inquiries initiated under Rajasthan Civil Services (Classification, Control & Appeal) Rules, vide annexure Nos. 10, 12 and the subsequent suspension wide annexure No. 23, may kindly be declared to be unconstitutional and without jurisdiction and may kindly be quashed; (ii) further by an appropriate writ, order or direction the non-petitioner Board may kindly be directed to pay the amount of salary to the petitioner due with effect from 1.4.2000 up to 28.2.2001 alongwith the arrears due on account of annual grade increments falling due on 1.9.1999 and 1.9.2000. (iii) further by an appropriate writ, order or direction the non-petitioner Board may kindly be directed to pay gratuity, pension and other consequential benefits to the petitioner alongwith the leave salary of 300 days in lieu of the earned leaves in balance in the leave accounts of the petitioners; (iv) further by an appropriate writ, order or direction the non-petitioner Board may kindly be directed to pay the amount of D.A. deducted and accumulated by the non-petitioner Board from time to time deductions from the salaries of the petitioners; (v) further by an appropriate writ, order or direction the non-petitioner Board may kindly be directed to pay penal interest to the petitioner for non-payment." 2. Both the learned counsel, by way of submitting an agreement, entered between both the parties (petitioner and respondents) submit that both the parties with mutual consent want to resolve the matter. They further submit that the petitioner and non-petitioner had agreed for the undisputed amount of Rs. 6,21,736.00 to be paid to the petitioner. In the mutual agreement it is mentioned that Rs. 3,05,000/- has already been paid to the petitioner, Rs. 50,000/- shall be paid to the petitioner within 15 days, remaining amount shall be paid to the petitioner @ Rs. 10,000/- p.m., which shall be paid within a week of every month and for other claims the petitioner may move his representation to the non-petitioner. The prayer made by both the learned counsels is allowed and the agreement entered in between both the parties shall be taken on record. 3. In view of the above agreement entered in between both the parties, the present writ petition stands disposed of.Writ Petition Disposed of in terms of Agreement. *******
