ORDER Heard learned counsel for the petitioners and the Patna University. None appears on behalf of Principal, Patna Medical College & Hospital, Patna, in spite of service of notice for appearance in these proceedings in compliance of the order dated 13.12.2007. 2. Petitioners appeared in the Post Graduate Medical Admission Test, 2006 and after becoming successful in the said test they were offered admission in Diploma course of various medical disciplines as has been stated in paragraph-2 of the second supplementary affidavit filed on their behalf. They have come to this Court for a direction to the Patna University to issue them admit cards for appearing in the Post Graduate Diploma Examination for the session 2006-08 schedule to commence on 16.4.2008 as from the date of their admission on 20.6.2006 after second counselling they have not completed the required two years before the date on which the examination is to begin i.e. on 16.4.2008. 3. It is submitted on behalf of the petitioner that the second counselling and admission pursuant thereto was not made earlier as there was a stay order passed by Hon'ble Supreme Court which delayed the process of second counselling as also the admission of the petitioners and thereby on the date of examination i.e. 16.4.2008 they have not completed the required two years. It is further submitted on behalf of the petitioners that they have prosecuted the course since their admission in the course to the satisfaction of all concerned and as such they should not be deprieved from appearing in the examination on account of stay order passed by the Apex Court. 4. None has appeared on behalf of the Patna Medical College. Patna, to oppose the submission. 5. Learned counsel for the University accepts the position that on account of stay order of the Hon'ble Supreme Court there was delay in admission of not only the petitioners pursuant to the second counseling but also of those who were admitted pursuant to first counseling. 6. In view of submissions of the learned counsel for the parties that delay in the petitioners admission arose on account of stay order, I deem it expedient to direct that the petitioners be allowed to appear in the Diploma Examination, 2008 conducted by the Patna University and their results be declared in the light of their performance in the said examination. 7. This application accordingly stands disposed of.
