JUDGMENT : Pradip Mohanty, J. - Heard Mr. Ragada, learned Counsel for the Petitioners, Mr. Mishra, Learned Addl. Standing Counsel, and Mr. Patel, Learned Counsel for Opposite party No. 2. 2. In this application u/s 482 Code of Criminal Procedure, the Petitioners seek to quash the order dated 21.06.2003 passed by the learned S.D.J.M. (S), Sambalpur in C.T. No. 1254 of 2002 taking cognizance against them under Sections 341/323/ 294/34 Indian Penal Code. 3. Learned Counsel for the Petitioners submits that in the meantime at the intervention of the well-wishers and relations, the dispute has been amicably settled between the parties. In view of such settlement, the informant does not want to prosecute the case and to the said effect he has also filed an affidavit. Therefore, the above noted proceeding may be quashed, in view of the ratio decided in Sura @ Suranath Jena v. State of Orissa, 2007 (37) OCR 200, Sridhar Pani v. State of Orissa, (2003) 25 OCR 447 and Bibhabasu Mohanty @ Chiku v. State of Orissa, (2006) 33 OCR 70. 4. Mr. Patel, Learned Counsel appearing for the informant-opposite party No. 2. also admits the above fact and prays that in the interest of both the parties-the proceeding may be quashed. 5. Mr. Mishra, Learned Addl. Standing Counsel submits that since charge sheet has been filed against the Petitioners after due investigation under Sections 341/323/294/34 Indian Penal Code, out of which the offence u/s 294 Indian Penal Code is no compoundable, the proceeding should not be quashed. 6. Perused the records including the affidavit filed by the informant. After going through the aforesaid decisions cited by the parties and considering the submissions made by the parties, this Court is of the opinion that chance of conviction of the Petitioners in this case is bleak. No fruitful purpose would be served in continuing the above criminal proceeding. Therefore, this Court, in exercise of the powers u/s 482 Code of Criminal Procedure quashes the proceeding in C.T. No. 1254 of 2002 (arising out of Sambalpur Town P.S. Case No. 220 of 2002) pending before the S.D.J.M., Sambalpur. 7. The Crl. MC is allowed. 8. Urgent certified copy of the order be granted as per rules. 9. Crl. MC allowed.
