JUDGMENT 1. - Heard learned counsel for the applicant, learned Public Prosecutor for the State and perused the relevant material before me. 2. By order dated 7.2.2008 learned public prosecutor was directed to produce the 1.0. but inspite of repeated adjournments 1.0. has not been produced in the court. 3. Learned counsel for the applicant submits that skin, bone or any other remains of the body of the tiger have not been recovered and there is no witness to state that the tiger was killed by the applicant. He submits that neither there is direct evidence nor there is any circumstantial evidence. 4. Learned public prosecutor is not able to controvert. 5. Considering the submissions and all the facts and circumstances of the case, I deem it proper to release the accused-applicant on bail under Section 439 Cr.PC. 6. It is, therefore, ordered that the applicant Smt. Motiya Bai wife of Pappu in F.I.R. No. 818-10/26.12.2007 registered at Police Station, Tiger Project, S. Madhopur be released on bail provided she furnishes a personal bond in the sum of Rs. 50,000/- together with two surety bonds in the amount of Rs. 25,000/- each (status verified by Tehsildar or any other senior revenue officer) to the satisfaction of the learned trial court with the stipulation to appear before that Court on all dates of hearing and as and when called upon to do so.Bail application allowed. *******
