JUDGMENT Hon’ble Barkat Ali Zaidi, J.—Heard Sri Yashwant Singh, Advocate for the applicant and Sri Arvind Tripathi, Additional Government Advocate for the State. 2. The trial Court rejected the bail that there are two witnesses, who saw the accused in the course of occurrence and he is named in the F.I.R. It seems a little improbable that the accused known to so many persons, came with open face, with dacoits for looting his co-villagers. 3. We, therefore, feel inclined to grant bail. 4. The appellant be released on bail on his furnishing a personal bond of Rs. 15,000/- with one surety in the like amount to the satisfaction of Chief Judicial Magistrate, Moradabad. 5. However, any observation in the bail order should not hinder the trial Court in arriving at its own conclusions, on basis of the evidence, adduced in the case. ————
