ORDER : 1. UPON hearing counsel the Court made the following: In the city of Faridabad and Gurgaon, so far, natural gas distribution has not come into effect. Various agents have been trying to have gas connection in these two Cities of State of Haryana. Gas Authority of India Ltd. has already entered into a tentative agreement with the Indraprastha Gas Ltd.(IGL) to have distribution in these cities of State of Haryana. As there is no gas connection in these cities, the vehicular pollution is on rise and is thus causing pollution level in the cities is going up. 2. Haryana City Gas Distribution Ltd. claims to have already laid down pipelines in the city of Gurgaon for supplying gas and Adani Energy Ltd. has also claimed to have laid down pipelines in the city of Faridabad for supply of natural gas. However, these pipelines have no connectivity to the main grid so they are not in a position to supply gas to its customers. IGL has also not given connectivity to these two concerns. The matter has been under consideration for quite a long time and there are disputes between these two parties and also with the Union Govt. and GAIL. We are told that no final decision has been taken in this regard. The IGL is now getting supply of 0.7 MMSCMD per day. As an interim agreement we are told that 0.2.5 MMSCMD would be sufficient to cover supply to Gurgaon and the same quantity i.e. 0.2.5 MMSCMD would be sufficient to supply natural gas in the city of Faridabad. As an interim measure IGL is directed to give supply of natural gas of 0.2.5 MMSCMD each to the two parties named above for distribution in Faridabad and Gurgaon. 3. Meanwhile, for giving connectivity, GAIL with their Engineers and Cnsultants shall supervise and ensure that the pipelines as claimed to have been laid with utmost safety and security. This should be done within a period of two weeks i.e. before 21st April, 2008. IGL shall see the supply is effective from 21 st April, 2008 onwards for a period of one month if safety measures are there. The price of gas supply by IGL in each case would be determined by GAIL. The matter shall be posted on 16.5.2008. This order is passed without prejudice to the rights of GAIL to supervise and lay down pipelines.
