Judgment :- (1.) Although, the matter is appearing under the heading for order, by consent of the parties, we take up the appeal for hearing. (2.) This is an appeal against the judgment and order dated March 5, 2008 passed by the Honble Single Judge of this Court in W. P. No. 4028(W) of 2008. (3.) The writ petitioner is working as an ad hoc librarian of Dharsa Mihirlal Khan Institution, Village-Dharsa, Post Office- G.I.P. Colony, District- Howrah, for ten years. (4.) The authorities have, now, proposed to fill up the said post permanently. (5.) The petitioner contends that he could be permitted to participate in the selection process. There is no difficulty in this behalf, but by this time he has become over aged. (6.) In substance, the prayer is to relax the age to enable him to participate in the selection process. (7.) We are of the opinion that the Honble Single Judge is right in holding that there is no power of age relaxation by the Court. (8.) Mr. Sukumar Bhattacharyya, learned Advocate appearing on behalf of the appellant, cites a decision in the case of State of M. P. and Ors. v. Yogesh Chandra Dubey and Ors., reported in 2006 (3) SCC 67. (9.) Mr. Bhattacharyya requests us to read Paragraph-15 of the said judgment. (10.) We are of the opinion that the Honble Single Judge was also right in her observations that the direction contained in State of M. P. and Ors. (supra) to consider relaxation of age was passed by the Honble Supreme Court of India in exercise of its power under Article 142 of the Constitution of India. This Court does not posses similar power. (11.) Therefore, there is no substance in this appeal. The appeal is dismissed, although we have sympathy for the writ petitioner-appellant. (12.) In view of dismissal of the appeal, no separate order is passed in relation to the application for injunction. The application for injunction being C. A. N. No.4619 of 2008 is, also, dismissed. (13.) We direct the parties to bear their respective costs in this appeal. The office is directed to supply the xerox certified copy of this order to the applicant, if applied for, on urgent basis.
