JUDGMENT : Pradip Mohanty, J. - Heard Mr. A. Mishra, learned Counsel for the Petitioners, Mr. Mishra, learned Addl. Standing Counsel and Mr. Nayak, learned Counsel for opposite party No. 2. 2. This Criminal revision is directed against the order dated 26.2.2008 passed by the J.M.F.C., Chandikhol in I.C.C. Case No. 464 of 2007 taking cognizance u/s 379/34 Indian Penal Code. 3. Having heard the counsel for the respective parties and after going through the records, this Court is not inclined to interfere with the impugned order of cognizance. 4. However, this Court directs the Petitioners to surrender and apply for bail before the learned J.M.F.C., Chandikhole in connection with the above noted case on or before 15th September, 2008, and in such event the learned Magistrate shall admit them to bail on such terms and conditions as he would deem just and proper. 5. The CRLREV is accordingly disposed of. 6. Urgent certified copy of the order be granted as per rules.
