body2008
Judgment 1. We heard counsel for the appellant. The counsel would urge that the appellant being a government employee, award of cost may affect him prejudicially. He also submitted that the appellant having already appeared in the examination along with the petitioners in C.W.J.C. Nos. 10095 of 2005 and 11779 of 2005 and passed the examination, the award of cost was unnecessary. 2. If the appellant has already appeared in the examination along with the petitioners in C.W.J.C. Nos. 10095of 2005 and 11779 of 2005 and passed the said examination, obviously, the appellant cannot have any grievance with regard to the examination. However, looking to the conduct of the appellant and false allegation of illegal demand of Rs.600/-, if the Single Judge awarded the cost of Rs.500/-, such direction cannot be faulted. Appeal is dismissed in limine.
