Judgment 1. In view of the statement made by the counsel for the Bihar State Hindu Religious Trust Board, that now the Tribunal has been constituted under Section 43, the senior counsel for the appellant prays for withdrawal of this appeal with liberty to the appellant to assail the correctness of the order dated 10th August, 2007 before the Tribunal. 2. The prayer is fair and reasonable. 3. The letters patent appeal is, accordingly, allowed to be withdrawn with liberty to the appellant to approach the Tribunal constituted under Section 43. 4. We further observe that the order passed by the Single Judge shall not come in the way in consideration of the matter by the Tribunal on merits in accordance with law.
