Judgment 1. After having heard the counsel for the appellant, we are satisfied that the following order shall meet the ends of justice: (i) In case there is no other claimant seeking retiral benefits of late Rakesh Prasad (husband of the present appellant) and she gives indemnity bond to the Indian Oil Corporation Limited, the said Corporation shall give retiral benefits to the present appellant. On the other hand, if there are rival claimants seeking retiral benefits of the deceased employee Rakesh Prasad, the appellant shall have to get a succession certificate from the competent court. (ii) As regards pension, it is directed that in case the appellant is the only eligible person for getting family pension being the wife of deceased employee Rakesh Prasad, Indian Oil Corporation Limited shall consider this aspect afresh in accordance with law and pass an appropriate order concerning the pension. 2. With the aforesaid observations, appeal is disposed of.
