Judgment 1. Heard learned counsel for the petitioners and learned counsel for the State. 2. Third supplementary show cause on behalf of State and its authorities has been filed on 23.6.2008 annexing Annexure- H, which is Letter No.1/C2-254/07 U.SH.01 dated 5.6.2008 in which it has been specifically mentioned that in view of order dated 26.3.2008 passed in M.J.C. No. 1198 of 2007 Rs. 6,57,93,452.00 has been approved by the Government for payments of retiral dues to 246 retired teachers of the University. The said amount has been sent to the University and admittedly it has been received in the University on 17.6.2008. 3. In spite of the aforesaid fact, no payment has been made to the said retired teachers till date on the pretext of strike of non-teaching staff of the University. It is shocking to learn that although the working staff, teachers and authorities of the University are getting their salary during this period but only the hard pressed retired teachers of the University are not being paid the arrears of retiral dues, although they have been sent by the Government to the University. It is shameful that the retired persons, who had spent their prime of life imparting education to thousands of students, out of whom several have no become University authorities, are deprived of their rightful dues at the time they need it most, by their own erstwhile pupils, who now adorn important positions in the University, although by their said negligence, which at times becomes criminal negligence, they prove that they do not deserve such positions. 4. In the said circumstances, the Registrar of Patna University shall not be paid any salary from the university unless the abovementioned amount sent by the State is reimbursed to the retired teachers, as per the list of retired teachers sent by the University to the State Government, which is Annexure-G to the third supplementary show cause filed on behalf of the opposite party nos.1 and 3. 5. This order is being passed in presence of the Registrar of Patna University and its learned counsel. Put up this case under the same heading on 11.8.2008 retaining its position.
