ORDER On July 4, 2008, this court passed an order asking the petitioner to deposit Rs. 796.11 lakhs along with simple interest. The relevant portion of the said order is reproduced hereinbelow:- The petitioner is directed to deposit the amount of Rs. 796.11 lakhs along with simple interest at PLR with effect from May 6, 2002 till the deposit, in this court not later than three weeks from today. Subject to deposit of aforesaid amount of Rs. 796.11 lakhs along with simple interest at PLR with effect from May 6, 2002 till the deposit in this court within the stipulated period, the operation of the impugned order of the AAIFR dated February 12, 2008 shall remain stayed until the next date. On September 3, 2008 this court passed the following order : At the request of learned counsel for the petitioner, list on September 29, 2008. In the meanwhile, the order dated July 4, 2008 is required to be complied with failing which the petition shall be liable to be dismissed. The stay granted by this court on July 4, 2008 has been enjoyed by the appellant without complying with the pre-condition of deposit. We are satisfied that no ground for interference has been made out specially when the appellant was under a legal obligation to repay the amount of sales tax of Rs. 7.96 crores collected by it, to the Government of State of Haryana. Accordingly, the writ petition has no merits and stands dismissed.
