JUDGMENT Hon'ble Prafulla C. Pant, J. Heard learned counsel for the parties. 2. By means of this writ petition, the petitioner has sought writ in the nature of certiorari quashing the order dated 19.11.2007, Annexure 1 to the writ petition, and order dated 12.07.2004, Annexure 2 to the writ petition. The impugned orders show that the petitioner's case for compassionate appointment has been rejected by the authority concerned. 3. It appears that earlier the petitioner filed a Writ Petition No. 1028 (SS) of 2007, wherein following directions were issued on 7.8.2007 by this Court :- "....Considering the facts of the case, I deem it fit and proper to direct the respondent no. 3 to take decision on the representation of the petitioner dated 10.01.2005 (Annexure no. 8 to the writ petition) within a period of four weeks from the date of production of certified copy of this order......" 4. In compliance of aforesaid order the representation appears to have been considered and disposed of by the authority concerned with a detailed and reasoned order. Relevant Paras of impugned order dated 19.11.2007 are being reproduced below :- "....The matter was considered by the H.P.C. in detail taking into consideration all the facts as mentioned in your representation and it was observed that Smt. Savitri Devi, Ex-official who was a compassionate appointee in place of her husband expired on 26.6.2002 at the age of 59 years 3 months, just before 09 months of her superannuation. She was survived by one son (age 25 years) & two daughters (age 34 & 29 years). Due to age factor, under rules, nobody was eligible for family pension. Other terminal benefits were Rs. 1,44,027/-. Both daughters were earning members before their marriage. Having own house was due to the fact that the applicant in his application mentioned his address as permanent address and no where it was stated that it is rented house. Your representation has been re-evaluated on the weightage point system taking into account the wholly dependent family members, financial status including family pension, terminal benefits, any other income, left out service of Smt. Savitri Devi, special weightage if widow is applicant. Special weightage if family is living in rented house, earning members in the family (if any) etc. ............. Total Points 44.
Special weightage if family is living in rented house, earning members in the family (if any) etc. ............. Total Points 44. As per BSNL letter dated 27.06.2007 referred above, the cases securing 54 points or less cannot be considered to be living in indigent condition and requests of such applicants are thereby rejected. As such, the request forwarded by you for appointment on compassionate ground is hereby rejected." 5. In the above circumstances, having heard learned counsel for the petitioner and learned Standing Counsel for the respondents and after going through the impugned orders, this Court is not inclined to interfere in the matter. 6. The writ petition is dismissed in limine.
