JUDGMENT 1. - With the consent of the parties, this writ petition is being finally 1 decided at this stage. 2. By this writ petition, the petitioner has prayed that the result of due papers of IVth Semester held in the year 2006 be declared. He has sought relief for consequential issuance of mark-sheets. Prior to filing of the present 5 writ petition, the petitioner has filed a writ petition in the year 2006 when he was not allowed to appear in the due papers of IVth Semester. The said writ petition was disposed of by this court with the direction to the University to consider his application as per rules. In compliance of the said judgment, the application of the petitioner was considered and he was allowed to appear in due papers of IV Semester. 3. The grievance was raised subsequently in this writ petition that the result of IV Semester, has been withheld without any justification. 4. The counsel for the petitioner submits that the petitioner has been selected in Indian Institute of Management & Planning for Higher Studies 1 at Bangalore, therefore, in case the result is not declared and mark-sheets are not received by him within a week, then his admission would be cancelled. 5. The counsel for the University has produced the result of the petitioner before this court which was seen or 28.02.2008 and returned with the observation that the writ petition is required to be decided on merit. 6. The counsel for the respondent-University submits that unless result of the IV Semester along with due papers is declared by the University, the petitioner has no right to ask for issuance of mark-sheets. In fact the result was with-held on account of the direction issued by this court as indicated above. 7. I have gone through the record of the writ petition and further considered the submissions of the parties. 8. In my view, the direction issued by this court in the earlier writ petition, as indicated above, is not an interim direction but same is a final order as the writ petition was disposed of, therefore, there was no justification for the University to with-hold the result of IV Semester. 9. Accordingly, the writ petition is allowed. 8. Accordingly, the writ petition is allowed. The respondent-University is directed to declare the result of the petitioner of IV Semester along with due papers forthwith and thereafter issue the mark-sheets in accordance with rules.Writ Petition Allowed. *******
