JUDGMENT 1. - This writ petition has been filed by the petitioner way back in the year 2004 with the prayer that the action of the respondents in keeping the displinary proceedings pending against him, be declared illegal, arbitrary and malafide and same be quashed and set-aside with direction to the respondents to pay all consequential benefits to him. 2. Petitioner contended that he was initially placed under suspension vide order dated 21/11/2002 on the basis of preliminary enquiry. The Deputy Conoservator of Forest, Jaipur West Jaipur in his letter written to Chief Conservator of Forest (Adm.) informed that no charge was actually made out against the petitioner. The suspension of the petitioner was therefore revoked on 25/6/2003 however, respondents have so far not passed any final order. 3. Respondents in reply to the writ petition submitted that the allegation against the petitioner was that he had encroached upon the forest lands and villagers of village Ghat Ke Balaji, Jaipur lodged a complaint in this regard against the petitioner. Thereupon, the Assistant Conservator of Forest was appointed as Enquiry Officer vide order dated 20/9/2002. It is not denied that enquiry is pending against the petitioner. 4. In the facts of the case, it is clearly evident that respondents have continued the enquiry proceedings pending against the petitioner for such a long time. Reply to the writ petition was filed on 14/9/2005 and till date, it is not known whether the enquiry is pending or not. 5. Having regard to the facts of the case, the respondents are directed to conclude the departmental proceedings against the petitioner and pass a final order within a period of six months from the date, copy of this order is served on them. 6. With the above direction, the writ petition is disposed of. 7. A copy of this order be endorsed to the petitioner for information.Writ Petition Disposed of. *******
