JUDGMENT : Arijit Pasayat, J. In view of the judgment of this Court in Commissioner of Customs (Import) Bombay v. M/s. HICO Enterprises, [ 2008(11) SCC 720 ], this appeal deserves to be dismissed which we direct accordingly.
