JUDGMENT : 1. Shri Raman Singh Solanki, learned Advocate for the applicant. Shri Manish Joshi, learned Panel Lawyer for the respondent/State. 2. Arguments on the first bail application of the applicant Kamlesh @ Kamalsingh for grant of bail under section 439 of the Criminal Procedure Code heard. 3. The applicant Kamlesh @ Kamalsingh is involved in Crime No. 33/2009 registered at Police Station Bhakatgarh, District Alirajpur for the offence punishable under section 302 of the Indian Penal Code. 4. It is alleged that on 16-5-2009 in the marriage procession of the daughter of Dumarsingh, the deceased Abhaysingh and accused Kamlesh @ Kamalsingh both were dancing. At that time, the drum beater stopped the drum, at that point Abhayasingh said the drum beater to beat the drum. Kamlesh questioned his authority. At this dispute applicant Kamlesh pushed Abhayasingh, who fell down and thereafter, Kamlesh took out a stone and assaulted Abhayasingh with the stone causing injury in a chest due to which he succumbed. 5. It has been argued on behalf of the applicant that the incident took place due to sudden quarrel. There was no intention to kill him. Deceased succumbed due to chest injury. Challan has been filed. Trial will take time. Hence, he should be released on bail. 6. The prosecution has opposed the bail application. 7. Considering the circumstances, the bail application is allowed. It is ordered that the applicant Kamlesh @ Kamalsingh be released on bail upon his furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand Only) with one surety in the like amount to the satisfaction of the trial Court for his appearance before the said Court on the dates of hearing as may be fixed in this behalf. M. Cr. C. is, accordingly, disposed of. C.C. today as per rules.
