JUDGMENT 1. - Heard learned counsel for the parties and perused the record made available to me during the course of arguments of the case. 2. Learned counsel for the petitioner submits that co-accused was granted bail looking to the fact that the main allegation exists against Prabhudayal Yadav, who had received money. It is stated that the bail application of Prabhudayal has already been rejected, but the case of the petitioner is distinguishable from that of Prabhudayal because the petitioner is only a witness to the document, thus, the petitioner may be granted bail. 3. On the other hand, learned Public Prosecutor and learned counsel for the complainant have opposed the bail application. 4. After considering the rival submissions made by learned counsel for the parties and without expressing my opinion on the merits and demerits of the case, but looking to the facts and circumstances of the case, I am inclined to accept this bail application so moved under Section 438 CrP.C. Accordingly, this bail application is accepted. 5. Therefore, the Investigating Officer of the Police Station Sadar, Jaipur City is directed that in the event of arrest of the petitioner, namely, Ramchandra Yadav S/o Shri Laxmichand Yadav, in FIR No. 184/2008 registered under Section 420, 406, 467, 468 and 120-B IPC, he shall be enlarged on bail, provided he furnishes a personal bond in the sum of Rs. 20,000/- together with two sureties in the like amount to his satisfaction on the following conditions (i) He shall make himself available for the interrogation by Investigating Officer as and when required; (ii) He shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any Police Officer; (iii) He shall not leave India without the previous permission of the Court. (iv) He shall not involve himself in the same or similar offence during the period of bail. Bail application allowed with usual conditions. *******
