ABHINAVA UPADHYA, J. Heard Ms. Ranjana Agnihotri, learned counsel for the petitioner, Sri B. L. Verma, learned counsel for opposite party No. 1 and Sri A. R. Khan, learned counsel appearing for opposite parties No. 2 to 4. The present writ petition has been filed seeking a direction to the appellate authority to decide the appeal. Learned counsel appearing for the respondents has urged that no appeal has been filed according to the procedure prescribed in the act and, therefore, no such direction can be issued by this Court. On the other hand, learned counsel for the petitioner insists that the appeal is pending before the authority concerned and some appropriate decision must be taken on the same. Be that as it may, the writ petition only for seeking a direction to decide the appeal is not maintainable. However, it is open for the petitioner to make an application before the authority concerned to consider the appeal pending before it, if the same has been filed in accordance with law. With the aforesaid observation, the writ petition is disposed of. .
