i{k viuk okn O;; Lo;a ogu djsaxsA The point which has been a lengthened issue in context of the delegation of 26.7.99 pertains to serial No. 25 and 35 of column No.4 of the first schedule.
This is in respect of the delegation of powers made to the Dy. Registrar's, Serial No. 25 is in respect of section 55 (2) whereas Serial No. 35 is in respect of section 64. The July 99 delegation at Serial No. 1 in column No.4 in the first schedule has the following order: "All powers of registrar in respect of all types of societies except (a) financing bank (b) all societies whose area of operation extends beyond the limits of district." Further as regards the extent of delegation under section 55 (2) the Deputy Registrar "had all powers of the Registrar of those societies which he or the Registrar can Register" and in respect of section 64 "all powers of the registrar in respect of all societies." It is thus clear that under the specific delegation of section 55 (2) of section 64 the Deputy Registrar could hear matters in respect of any societies but for the rider of serial No.1. This issue agitated before the Hon'ble High Court seems to have also been in consideration of the Govt. as the Govt. of Madhya Pradesh had issued an amendment in its notification dated 26.7.99 vide notification No. F-5-l/ 99-XV-5 dated 25.6.07 which has now bifurcated the powers of Deputy Registrar under section 55 (2) and section 64 in following two category. In respect of section 55 (2) the Dy. Registrar now has following powers: 1. All powers of the Registrar in coop. soc. which he can register 2. All powers of the Registrar in respect of the cases which are transferred under subsection 1 of section 66 by Registrar or Divisional Joint Registrar. Similarly section 64 Deputy Registrar has following powers :- 3. All powers of Registrar in respect of all societies 4. All powers of Registrar in respect of cases which are transferred under subsection 1 of section 66 by Registrar or Div. Joint Registrar. Apparently this amendment is by way of making the delegation of Dy. Registrar more explicit and enabling which with no stress of imagination seems to be devoiding the Dy. Registrar of the inherent jurisdiction. The learned counsel's also made a reference to a tribunal's decision in S.A. 20/70 "Sivaram Singh Sikarwar v. Nagrik Bank Gwalior" where in order dated 5.6.08 tribunal has remitted a dispute to the Joint Registrar Gwalior.

Firstly, whereas it is a consented order, it does not leave any doubt that the Joint Registrar cannot himself decide a matter of 55 (2) or 64 himself. As a matter of fact the cases of banks have got to be presented to the Joint Registrar only and he can thereafter take a decision to decide it himself or to transfer it to a nominee. The above analysis should now leave no ground for any confusion and our present considered view should now remain open that a dispute under section 64 presented to Joint Registrar can well be transferred to a Deputy Registrar under section 66 (1) whose decision in the matter will be a qualified one in respect of jurisdictional competence.
