JUDGEMENT 1. Heard the parties. 2. There is no chance of any patch up and disposal of the matter cordially for which the matter was adjourned on 5.8.2009. 3. The case involves issuance of cheques to the tune of rupees Sixty seven lacs which all bunked on account of insufficient fund. The case is being tried by a Magistrate. I direct the Magistrate trying the case to peruse the provision of Section 223 of the Code of Criminal Procedure and commit the case to the court of Sessions as in the opinion of this Court it ought to be tried by that court. 4. As regards the prayer for bail, the same is dismissed.
