JUDGMENT 1. - Heard learned counsel for the petitioner and learned Public Prosecutor for the State. Perused the relevant papers placed on record. 2. Shri Anshuman Saxena, learned counsel for the petitioner has prayed for release of the petitioner on second regular parole of 30 days. It is submitted that petitioner had already served h of his sentence of 5 years, 4 months & 27 days imprisonment without remission out of the total sentence of 7 years. His jail conduct was reported as satisfactory inasmuch as, the Assistant Director Social Justice & Empowerment Department, Jaipur also favourably recommended for his release. Petitioner wanted to get his release on second parole of 30 days on the ground of his undergone period of h sentence. The District Advisory Parole Committee has rejected the application of the petitioner for his second regular parole of 30 days on the basis of adverse police report. Earlier also, petitioner was granted parole for 20 days but he never misused the liberty granted to him. This fact is not controverted by the learned Public Prosecutor. 3. Considering the submissions made at the bar and the ground on which second regular parole of 30 days has been prayed for, I am inclined to grant to the petitioner second regular parole of 30 days. 4. In the result, the writ petition for parole is allowed. 5. It is, therefore, ordered that petitioner-Sheesh Ram S/o Shri Rati Ram, R/o Village Chhara, Post Gokul Ka Bas, Tehsil Shri Madhopur, P.S. Khendela, District Sikar (Rajasthan) who is at present confined in Central Jail, Jaipur shall be released on second regular parole of 30 days with effect from the date of receiving certified copy of this order by the Superintendent Central Jail, Jaipur provided petitioner furnishes a personal bond in the sum of Rs.20,000/- together with one surety in the like amount to the satisfaction of Superintendent Central Jail, Jaipur with the stipulation that the petitioner shall surrender himself before the jail authorities immediately after completion of 30 days effective from the date of his release.A copy of this order be endorsed to the Superintendent Central Jail, Jaipur separately.Writ Petition Allowed. *******
