JUDGMENT : Having heard learned counsel for the. parties, it could be noticed that the question involved in this appeal to the effect that the learned single Judge was in error in not directing the respondents-authorities to fix the pension on the basis of last salary drawn has already been adjudicated by a Division Bench judgment of this Court reported in 2009(2) JLJR 528 (Rameshwar Prasad vs. The Jharkhand State Electricity Board, Ranchi & Ors.), which has already relied upon a series of decisions reported in 2005(2) JLJR 187 , 2005(2) JLJR 705 as also (1995) Suppl.(1) SCC 18 and several authorities holding therein that it is the salary drawn by the officer, which is the determining factor for fixation of pension. 2. In view of this, the point raised by the petitioner-appellant that his pension was wrongly fixed on the basis of the scale of pay, is not legally sustainable and hence this appeal is dismissed, in view of the catena of the authorities referred to hereinabove.
