JUDGMENT Rajan Gupta, J (oral).:- This is a petition under Section 439 Cr.P.C. seeking regular bail in a case registered against the petitioner under Sections 326, 324, 323, 341, 506, 148, 149 IPC, later on added Section 307 IPC, at Police Station Shimla Puri, Ludhiana, vide FIR No.102 dated 24th May, 2009. 2. Learned counsel for the petitioner has submitted that charge has not been framed under Section 307 IPC. According to the counsel, only injury attributed to the petitioner is on left wrist of Khushal Singh, an injured witness. He further submits that the petitioner has been in custody since 24th May, 2009 and trial is still at its initial stage. Learned counsel, therefore, pray that the petitioner be enlarged on bail during the pendency of trial. 3. Learned counsel for the State has opposed the prayer for bail on the ground that allegations against the petitioner are serious. 4. Keeping in view the facts and circumstances of the case and the period of incarceration already undergone by the petitioner, no useful purpose will be served by detaining the petitioner in custody during the pendency of the trial as the trial may take long time to conclude. So, without expressing any opinion on the merits of the case, this petition is allowed and the petitioner is directed to be released on bail to the satisfaction of Chief Judicial Magistrate/Duty Magistrate, Ludhiana. ------------
