JUDGMENT Harbans Lal, J. (Oral) - This petition has been moved by Satnam Singh alias Satta under Section 439 of Criminal Procedure Code seeking regular bail in case FIR No. 63 dated 22.4.2009 registered under Section 15/12 of the NDPS Act. 2. The allegation against the petitioner is that 50Kgs of Popy husk was recovered from his possession. 3. I have heard the learned counsel for the parties. 4. Learned counsel for the petitioner submits that this recovery does not fail within the definition of commercial quantity and that the petitioner is in custody for the last four months. This apart the challan has not been presented as yet. 5. In view of Caluse VII (a) of Section 2 of the NDPS ACt, this quantity does not fail within the definition of commercial quantity. 6. Bail to the satisfaction of the learned Special Judge. Hoshiarpur.
