Judgment Mahesh Grover, J. 1. This is an application under Section 24 of the Code of Civil Procedure for transfer of Petition No. 107 of 2008 filed by the respondent under Section 13 of the Hindu Marriage Act, 1955 , titled "Yashpal Versus Smt.Tirishla", which is pending in the Court of District Judge, Jhajjar to the District Courts at Sonepat. 2. No one has appeared on behalf of the respondent despite service. On the last date, the matter was adjourned to await the appearance of the respondent, but none has put in appearance. 3. I have heard the learned counsel for the applicant and have gone through the file. The applicant has averred that she has been mal-treated by the T.A. No. 416 of 2008 respondent which led to a marital discord. It has further been averred that a petition under Section 12 of the Protection of Women from Domestic Violence Act, 2005 filed by the applicant is pending at Sonepat. The applicant has also contended that she has two minor children to take care of and it is extremely difficult to travel to Jhajjar where the petition under Section 13 of the Hindu Marriage Act, 1955 filed by the respondent is pending. 4. The averments made by the applicant have gone uncontroverted. 5. Therefore, having regard to the fact that the applicant has two minor children and the fact that a case initiated by her is pending at Sonepat and keeping in view the observations of the Supreme Court in Sumita Singh Versus Kumar Sanjay and another, AIR 2002 S.C. 396, this application is accepted and the petition under Section 13 of the Hindu Marriage Act, 1955 titled. "Yashpal v. Smt. Tirishla" pending in the Court of District Judge, Jhajjar, is ordered to be transferred to a Court of competent jurisdiction at Sonepat. The District Judge, Sonepat, shall, after receipt of the aforesaid petition, issue notice to the parties for further proceedings.
