This is an application under Section 24 of the Code of Civil Procedure for transfer of the petition filed by the respondent under Section 13 of the Hindu Marriage Act, 1955, titled "Balinder Kumar Versus Smt. Rimpal", which is pending in the Court of District Judge, Faridabad to the District Courts at Karnal. 2. Learned counsel for the applicant contended that an application for interim maintenance allowance and another case under Sections 323, 406, 498-A, 506 and 34 of the I.P.C. are pending in the Court of Illaqa Magistrate, Karnal and that after the applicant was deserted by the respondent, she was residing with her parents in District Karnal. He further contended that the applicant has a minor child aged about nine months and Civil Misc. No. 275 of 2008 -2- it is extremely difficult for her to travel from Karnal to Faridabad to attend the proceedings in the aforesaid petition for divorce. 3. On the other hand, learned counsel for the respondent contended that there is no reason to transfer the divorce proceedings from Faridabad to Karnal and that the respondent is interested in retaining the matrimonial alliance. 4. I have heard the learned counsel for the parties. 5. The applicant is present in Court. She has stated that the respondent had been subjecting her to mal-treatment. 6. Be that as it may, having regard to the fact that the applicant has a small child and the fact that two other matters are pending in Courts at Karnal and also keeping in view the observations of the Supreme Court in Sumita Singh v. Kumar Sanjay and another, AIR 2002 S.C. 396, this application is accepted and the petition under Section 13 of the Hindu Marriage Act,1955 titled "Balinder Kumar Versus Smt.Rimpal" pending in the Court of District Judge, Faridabad, is ordered to be transferred to a Court of competent jurisdiction at Karnal. 7. The District Judge, Karnal, shall, after receipt of the aforesaid petition, issue notice to the parties for further proceedings.
