JUDGMENT 1. - Heard learned counsel for the parties. 2. This appeal has been preferred on behalf of injured-appellant for enhancement of compensation awarded by the learned Motor Accident Claims Tribunal, Jaipur city, Jaipur vide judgment dated 18.9.1999 whereby a sum of Rs. 1,20,000/- was awarded by way of compensation for 26.66% disability sustained on account of injuries caused in the accident. 3. The challenge in the appeal pertains to quantum of compensation only. 4. Learned counsel for the appellant submits that the learned Tribunal has failed to award adequate compensation. It is further submitted that the Tribunal has awarded Rs. 78,000/- by way of compensation for loss of future income on account of disability but has failed to adopt appropriate multiplier. It is also submitted that the Tribunal has failed to award interest on the awarded amount while conditional order was passed that in case the amount is not paid within 15 days, interest @12% shall be payable and thus that interest deserves to be awarded. 5. Per contra, learned counsel for the respondents supported the judgment of the Tribunal and submitted that the learned Tribunal has taken into consideration evidence adduced during inquiry and has awarded adequate compensation and calls for no interference. 6. After hearing the rival contentions, and going through the award as also record of the case, it is revealed that the learned Tribunal has awarded compensation of Rs. 78,000/- by adopting multiplier of 13 while looking to the age of injured who was 28 years old, multiplier of 15 deserves to be adopted. It is further revealed that the appellant-injured deserves to be awarded interest on the awarded amount, if same has not been paid to him. Thus amount can be calculated as under: 2000 x 12 x 15 (multiplier) x 26.66% (disability) = 95,976-78,000 (already awarded) = 17,976/- (to be additionally awarded). 7. Accordingly, appeal of the appellants is partly allowed and the Award passed by the learned Tribunal is modified to the extent that the appellants shall get a sum of Rs. 17,976/- by way of additional enhanced compensation from the date of appeal i.e. 22.11.1999, with 6% interest to be paid within three months. Thereafter interest shall be paid @9% per annum.
