TIWARI, M.—This is a revision petition under Section 84 of the Rajasthan Land Revenue Act, 1956 (in short 'the Act') against the order dated 11.9.1998 of Naib Tehsildar Pisangan (District Ajmer) passed in mutation No. 7 dated 11.9.1998. 2. I have heard the learned counsel for the petitioner. Nobody appeared on behalf of the non-petitioners despite due service of summons on them. 3. The learned counsel for the petitioner argued that the impugned mutation order dated 11.9.1998 was passed beyond jurisdiction by Naib Tehsildar without enquiry and verification about the succession. The non-petitioner No. 2 Surendra is illegally shown as an adopted son of the deceased Khatedar Nanu whereas adoption is not proved. Surendra is totally a stranger to the land in dispute; as such the impugned mutation was illegally attested and carried out which should be cancelled and order dated 11.9.1998 of Naib Tehsildar should be set aside. 4. I have given thoughtful consideration to the contentions of the learned counsel for the petitioner and perused the impugned order dated 11.9.1998 of Naib Tehsildar passed in mutation No. 7 of village Daulat Khera Tehsil Pisangan District Ajmer. 5. Without going into the merit of the case I would first of all like to highlight the legal point that this revision petition is against the mutation order dated 11.9.1998 of Naib Tehsildar, whereas an order passed in attesting a mutation is an appealable order under Section 75 of the Act. Under Section 84 of the Act, Board of Revenue may call for the record of any case of a judicial nature or connected with settlement in which no appeal lies to the Board of Revenue if there is any jurisdictional error or illegality or irregularity committed by the lower Court. But in this case there is clear provision of appeal against the order of mutation passed by Tehsildar or any Land Record Officer under Section 75 of the Act. Hence, the revision against such an appealable order is prima facie not maintainable. 6. In view of the foregoing discussion, the revision is dismissed being not maintainable. Pronounced.
