The State of Uttarakhand has to construct a hill bypass road through the Rajaji National Park and it involves use of two hectares of forest land. The matter was examined by the CEC and the project is also cleared by the Standing Committee of the National Board for Wildlife, subject to the following conditions as enumerated in its report: 1. for the use of forest land, approval under the Forest (Conservation) 9 Act, 1980 will be obtained; 2. the NPV payable for use of forest land falling within the National Park will be deposited in the compensatory afforestation fund as per this Court's order dated 26-3-2008 in the NPV matter; and 3. the condition stipulated by the Chief Wildlife Warden and the Standing Committee of the National Board for Wildlife will be strictly h complied with. The conditions so imposed are acceptable to the State. IA is disposed of, subject to the fulfilment of above conditions. Court Masters
