CR No. 5750 of 2009 For the same relief claimed by the petitioner herein, an application under Order 7 Rule 11 CPC was filed which was dismissed. Petitioner challenged the aforesaid order vide CR No. 201 of 2009, however, this Court did not accept the plea of the petitioner and vide orders dated 15.1.2009 and 12.2.2009 passed in CR No. 201 of 2009 declined the prayer of the petitioner. Once that is so, I find no error in the order of the Civil Court rejecting his application under Order 6 Rule 17 CPC. 2. Faced with this situation, learned counsel for the petitioner wishes to withdraw the present revision petition. Civil Revision is ordered to be dismissed as withdrawn. Revision dismissed.
